Automotive lawyer

The term automotive covers the entire automotive and mobility sector. While the regulations within the mobility sector and the automotive industry are very complex and varied. Legal advice requires specialist knowledge of (European) law and the BER (Block Exemption Regulation). Knowledge that TEN Advocaten has in house.

Automotive
The Monti Regulation

The Block Exemption Regulation is still known as the ‘Monti Regulation’, a reference to Competition Commissioner Mario Monti. The objective of this regulation is to promote competition between market players. The more car importers, car dealers and brand dealers compete with each other, the more consumers should benefit. The regulation is regularly reviewed by the European Commission, almost always with a major impact on brand dealer networks. For example, there are legal issues surrounding the ending of dealerships, the termination of dealer contracts, authorised repairership, bonus issues or distribution agreements. These are issues we can support you with.

Dealer contracts and brand dealers

Often a new regulation causes restructuring of the dealer landscape, with car importers cancelling their national dealer contracts. In such cases, the sale of the dealership is often forced upon parties. The consequences for the brand dealer are far-reaching and therefore expert advice and the active involvement of a specialist is sorely needed. Automotive lawyer Peter Roosendaal has earned his spurs in the industry and guides brand dealers who are affected by a cancellation every year. Together with brand dealers, he looks for the best and most feasible solution for themselves and their company.
